General conditions

The general partnership Scandinavian Dreams (hereinafter: Scandinavian Dreams) is registered with the Dutch Chamber of Commerce under number 84800577 and has its registered office at Marktplein 5, 5296NA Esch, the Netherlands.

General terms

 

Article 1 - Definitions

1. In these General Terms and Conditions, the following terms shall have the following meanings, unless expressly stated otherwise.

2. Scandinavian Dreams: Scandinavian Dreams acts as an intermediary in the conclusion of Agreements for Travel Services on behalf of the Traveler, including but not limited to the rental of accommodations and the booking of boat trips, ski passes, ski equipment, ski lessons, dog sledding trips, and all associated services in the broadest sense.

3. Traveler: the natural person who enters into a Travel Services Agreement with Scandinavian Dreams.

4. Offer: any proposal or quotation made to the Traveler by Scandinavian Dreams for the provision of Travel Services.

5. Travel Services: the rental of accommodations, the booking of boat trips, ski passes, ski equipment, ski lessons, dog sledding trips, and all associated services in the broadest sense.

6. Agreement: the Travel Services Agreement between the Traveler and Scandinavian Dreams.

 

Article 2 - Applicability

1. These General Terms and Conditions apply to any Offer made by Scandinavian Dreams, any Agreement between Scandinavian Dreams and the Traveler, and to any Travel Service provided by Scandinavian Dreams.

2. Before an Agreement is concluded, the Traveler will be provided with these General Terms and Conditions. If this is reasonably not possible, Scandinavian Dreams will inform the Traveler of how the General Terms and Conditions can be reviewed.

3. Deviation from these General Terms and Conditions is not possible.

4. These General Terms and Conditions also apply to additional, modified, and follow-up assignments from the Traveler.

5. The applicability of Articles 7:404 and 7:407(2) of the Dutch Civil Code (BW) is expressly excluded.

6. If these General Terms and Conditions refer to 'she/her', this should also be understood as a reference to 'he/him/his', where applicable.

 

Article 3 - The Offer

1. All offers made by Scandinavian Dreams are non-binding, unless expressly stated otherwise in writing. If the Offer is limited or valid under specific conditions, this will be explicitly stated in the Offer.

2. Scandinavian Dreams is only bound by an Offer if it is confirmed in writing by the Traveler within the specified validity period.

3. The Offer contains a description of the Travel Services offered. The description is sufficiently detailed to enable the Traveler to make an informed assessment of the Offer. If the actual situation differs from the displayed images and/or information, this will be explicitly stated in the Offer to ensure the Traveler is clearly informed.

4. Offers or a renewed Offer do not automatically apply to follow-up assignments.

5. If the number of persons who can participate in a particular Travel Service is limited, or if other restrictions or conditions are imposed on the Travelers, this will be stated in the Offer.

6. An Offer from Scandinavian Dreams is made at the initiative of the Traveler, subject to the availability of third-party Travel Services. A compiled Offer does not obligate Scandinavian Dreams to provide a portion of the items included in the Offer for a corresponding portion of the stated price.

7. After an Offer has been made, Scandinavian Dreams is entitled to withdraw it from the Traveler and revise its prices if the price increase is the direct result of changes in an increased price over which Scandinavian Dreams has no control.

 

Article 4 - The Reservation Order for a Travel Service

1. If the Traveler places an order with Scandinavian Dreams in general terms, Scandinavian Dreams will inform and/or advise the Traveler and may, if desired by the Traveler, reserve a Travel Service. The Traveler is bound to Scandinavian Dreams as soon as the Traveler has placed an order with Scandinavian Dreams, even if the Traveler has not yet received a confirmation.

2. Due to the Agreement, the Traveler is obligated to provide all relevant information about themselves as well as their travel companions that is necessary for the provision of the Travel Services, including details (physical and/or mental condition) of fellow travelers.

3. Any prices for reserved Travel Services cannot be guaranteed. In accordance with the terms and conditions of the respective service provider, these prices may change. Scandinavian Dreams has no control over this.

4. In the case of sea transport, Scandinavian Dreams will disclose the identity of the shipping company.

 

Article 5 - Conclusion of the Agreement

1. The Agreement is concluded at the moment the Traveler accepts an Offer from Scandinavian Dreams by returning a signed copy (scanned or original) to Scandinavian Dreams, or by giving explicit and unequivocal consent to the Offer via email.

2. The Traveler must be 18 years or older and legally competent to place an order with Scandinavian Dreams.

3. The Traveler is required to provide accurate information (even when making a booking on behalf of multiple Travelers) upon which the Agreement will be based, as specified in Title 7A of Book 7 of the Dutch Civil Code with respect to the Agreement. The Traveler is liable for the fulfilment of all obligations concerning all co-Travelers under the Agreement.

4. Scandinavian Dreams is not bound by an Offer if the Traveler could reasonably have expected, or should have understood, that the Offer contains a clear mistake or misstatement. The Traveler cannot derive any rights from such a mistake or misstatement.

5. After the Agreement has been concluded, the Traveler will receive, if available, information regarding the required travel documents no later than 24 hours before departure. The Traveler is responsible for obtaining additional information and keeping this information up to date. If the Traveler does not receive the relevant information within this period, the Traveler must contact Scandinavian Dreams.

6. The Traveler is responsible for having the required documents during the Travel Service. If, due to the lack of necessary information, the Traveler is unable to complete the Travel Service or cannot do so in full, the Traveler must bear the costs unless Scandinavian Dreams explicitly agreed to provide the relevant documents and has failed to fulfil its obligation to provide such information.

7. If the Agreement is entered into by multiple Travelers, each Traveler is jointly and severally liable for the fulfilment of all obligations arising from the Agreement, unless otherwise agreed.

 

Article 6 - Cancellation of the Agreement

1. The Traveler is at all times entitled to terminate the Agreement via email before the commencement of the Travel Services. Upon termination, the Traveler must compensate Scandinavian Dreams for any damages incurred as a result of the cancellation, including any previously agreed standardized termination fees. The cancellation periods for various Travel Services are guidelines and are outlined below:

Ferry crossing:

If you have booked a flexible ferry ticket and the cancellation is communicated to us at least 48 hours before the scheduled departure time, you will receive a full refund of the amount paid. The amount will be refunded via the original payment method, unless otherwise agreed.

If you have booked an economy ferry ticket at a reduced rate, no refund or compensation will be provided. In the event of cancellation of an economy ticket, regardless of the time of cancellation, you, as the Traveler, are liable for the full travel amount.

Accommodations for up to 15 persons:

If the Agreement was entered into 60 days or more before arrival, the reservation can be cancelled free of charge up to 60 days before arrival. You will receive a full refund of the amount paid. The amount will be refunded via the original payment method, unless otherwise agreed.

If the Agreement was entered into within 60 days of arrival, the Agreement can be cancelled free of charge within 3 days of the invoice date. In case of cancellation after these 3 days, no refund will be provided, and you, as the Traveler, are obliged to pay the full travel amount.

Accommodations for more than 15 persons:

If the Agreement was entered into before June 15, the reservation can be cancelled free of charge up to 90 days before arrival. You will receive a full refund of the amount paid. The amount will be refunded via the original payment method, unless otherwise agreed.

If the Agreement was entered into after June 15, but 90 days or more before arrival, the reservation can be cancelled free of charge within 14 days of the invoice date. In case of cancellation after these 14 days, but 90 days or more before arrival, 30% of the total accommodation price will be charged. In case of cancellation within 90 days of arrival, no refund will be provided, and you, as the Traveler, are obliged to pay the full amount.

If the Agreement was entered into within 90 days of arrival, the Agreement can be cancelled free of charge within 3 days of the invoice date. In case of cancellation after these 3 days, no refund will be provided, and you, as the Traveler, are required to pay the full amount.

Travel Services:

1. In principle, Travel Services cannot be cancelled and the Traveler will not receive a refund, but we will make our best efforts to refund the amount paid. We are dependent on the flexibility of our partners. The sooner the cancellation is made, the sooner Scandinavian Dreams can assist in this matter.

2. The Agreement may include reasonable, standardized termination fees based on the timing of the termination/cancellation of the Agreement prior to the commencement of the Travel Services and the expected cost savings and income from alternative use of the Travel Services. If no standardized termination fees have been set, the amount of the termination fee will correspond to the price of the Agreement minus the cost savings and income from alternative use of the Travel Services. Upon request by the Traveler, Scandinavian Dreams will provide an explanation of the termination fee amount.

3. Cancellation of the Agreement during the Travel Services is not possible.

4. In the event of unavoidable and extraordinary circumstances preventing the execution of the Agreement, Scandinavian Dreams is entitled to terminate the Agreement. The Traveler will be promptly notified, and Scandinavian Dreams will attempt to offer a suitable solution.

5. In the event of cancellation of the Agreement, the Traveler is responsible for indirect costs of the Travel Services, including but not limited to the cost of travel insurance and any vaccinations.

6. Cancellations must be communicated in writing to Scandinavian Dreams. Scandinavian Dreams will confirm the cancellation and cancellation fees within one business day.

7. Scandinavian Dreams has the right to terminate the Agreement with the Traveler immediately if the Traveler does not agree to a proposed equivalent alternative Offer when altering an Agreement. The Traveler will be promptly notified, and Scandinavian Dreams will attempt to offer a suitable solution.

8. Refunds, if applicable, will be processed within a reasonable period after the cancellation confirmation.

9. If the Traveler cancels the Agreement, it is only possible if done in writing, at least via email to info@scandinaviandreams.eu, mentioning the name and reservation number. The day the cancellation is received will be considered the cancellation date.

 

Article 7 - Amendment of the Agreement

1. Modifications to an Agreement by the Traveler are only possible if and to the extent that these modifications are approved and implemented by Scandinavian Dreams. A modification can only be submitted in writing.

2. If Scandinavian Dreams modifies the Agreement on behalf of the Traveler, a service fee of €50 may be charged.

3. Each modification must be submitted via email to Scandinavian Dreams. Scandinavian Dreams does not guarantee that the modification desired by the Traveler can actually be implemented. Scandinavian Dreams will promptly inform the Traveler in writing after receiving the modification request whether the request can be fulfilled, and if so, what the consequences will be for the travel price. The Traveler must approve the modified Agreement. Upon approval, the Traveler is obligated to pay the modified travel amount within the specified payment term.

4. Scandinavian Dreams is entitled to modify the Agreement if there are minor, insignificant changes, and does not need to notify the Traveler (in advance). The Traveler is obligated to accept this modification. In the case of a substantial modification, Scandinavian Dreams will, if possible, offer an alternative Offer to the Traveler. This Offer must be at least equivalent. The Traveler must inform Scandinavian Dreams of their decision within 24 hours in the case of urgent matters (or 48 hours if the Travel Service starts 14 days or more later) after notification. Failure to respond within the required time will result in automatic acceptance of the modification.

5. Scandinavian Dreams also has the right to modify the Agreement due to unavoidable extraordinary circumstances. Scandinavian Dreams will promptly, but as soon as possible, notify the Traveler of this modification. Starting 14 days before departure, Scandinavian Dreams will notify the Traveler of this modification within 24 hours.

6. It is possible for the Traveler and/or one or more Travelers in the travel group to be replaced by another person (substitution). The Traveler must inform Scandinavian Dreams of this at least 14 calendar days before departure, or as early as necessary for Scandinavian Dreams to complete the required actions and formalities. Scandinavian Dreams will accept the substitution if the replacement person meets the applicable conditions set by Scandinavian Dreams for the Agreement, as well as the (general) terms and conditions of the relevant (suppliers) and/or service providers. Regardless of whether the number of Travelers in the travel group is reduced, the original Traveler and the substitute Traveler will remain jointly and severally liable for the payment of the agreed travel amount and any additional costs arising from the substitution. Scandinavian Dreams will inform the party transferring the Agreement of the actual costs of the substitution.

 

Article 8 - Duration of the Agreement

1. If and to the extent that an Agreement has been concluded between the Traveler and Scandinavian Dreams, the duration of this Agreement shall be in accordance with what the parties have agreed upon.

2. Both the Traveler and Scandinavian Dreams may terminate the Agreement based on an attributable failure to comply with the Agreement if the other party has been formally notified in writing, and a reasonable period has been given to fulfil its obligations, and they fail to do so. This includes the payment and cooperation obligations of the Traveler.

3. The termination of the Agreement does not affect the Traveler's payment obligations if Scandinavian Dreams has carried out work or delivered services at the time of termination. The Traveler is obligated to pay the agreed fee.

 

Article 9 - Execution of the Services

1. Scandinavian Dreams shall make every effort to perform the agreed Services with the utmost care, as expected of a competent service provider. Scandinavian Dreams ensures professional and independent service. All Services are performed based on an obligation of effort, unless explicitly and in writing a specific result has been agreed upon, which is thoroughly described. If an element cannot be performed as agreed, Scandinavian Dreams will make every effort to fulfil these agreements, unless it is unreasonable to expect this from Scandinavian Dreams due to high costs.

2. The Agreement based on which Scandinavian Dreams performs the Services is leading for the scope and extent of the services.

3. The information and data provided by the Traveler form the basis on which the Services offered by Scandinavian Dreams and the prices are based. Scandinavian Dreams reserves the right to adjust its services and prices if the provided information is incorrect and/or incomplete.

4. Scandinavian Dreams is entitled to engage third parties at its discretion for the execution of the Services.

5. The execution of the Services is based on the information provided by the Traveler. If the information needs to be changed, this may affect any established schedule. Scandinavian Dreams is never liable for adjusting the schedule. If the start, progress, or completion of the Services is delayed because, for example, the Traveler has not provided all the requested information, not provided it on time, or not in the desired format, has not cooperated sufficiently, a deposit has not been received by Scandinavian Dreams on time, or there are other circumstances which are at the risk of the Traveler, Scandinavian Dreams is entitled to a reasonable extension of the delivery period. All damages and additional costs resulting from a delay due to a cause as mentioned above are at the expense and risk of the Traveler.

6. The following additional provisions apply to the Services:

  • In the case of defective performance of the Agreement, the Traveler is obligated to notify Scandinavian Dreams immediately, so that they can take the necessary measures to remedy the defect in time.

  • If a part of the agreed Services can no longer be fulfilled, Scandinavian Dreams must provide an equivalent quality alternative, without charging additional costs for this. If no alternatives are possible, the Traveler may be offered a price reduction. The Traveler is not obligated to accept the alternative. The Traveler may also remedy a deficiency themselves.

  • The Traveler is solely responsible for their actions during the execution of the Agreement.

 

Article 10 - Travel Services

1. As agreed, Scandinavian Dreams may also arrange additional Travel Services, such as ski passes, ski equipment, and more. The costs of the Travel Services will be passed on to the Traveler in accordance with the Offer.

2. The Traveler must inform Scandinavian Dreams in a timely manner of any special requests or requirements, so that Scandinavian Dreams can adjust the requested Travel Services accordingly.

3. If the Traveler is not satisfied with the Travel Services provided by Scandinavian Dreams or a third party engaged by them, they must notify Scandinavian Dreams in a timely manner, in accordance with the provisions of Article 11 of these general terms and conditions.

4. Due to the nature of the Travel Services offered by Scandinavian Dreams, they cannot guarantee the Travel Services that are (partly) dependent on the weather conditions at the location, such as the availability of ski passes, ski instructors, equipment, etc. To the extent that a Travel Service offered by Scandinavian Dreams depends on the weather conditions at the relevant location, the provisions of Article 21 regarding force majeure apply, and/or the terms and conditions of the third party involved in the actual provision of the Travel Service.

 

Article 11 - Obligations of the Traveler

1. The Traveler is obligated to provide all information requested by Scandinavian Dreams, as well as relevant attachments and related information and data, in a timely manner and/or before the commencement of the services and in the required format, for the proper and effective execution of the Agreement. If this is not provided, it may occur that Scandinavian Dreams is unable to fully execute and/or deliver the relevant services. The consequences of such a situation shall always be borne by the Traveler and at their risk.

2. Scandinavian Dreams is not obligated to verify the accuracy and/or completeness of the information provided to it, nor is it obligated to update the Traveler regarding any changes to the information over time. Furthermore, Scandinavian Dreams is not responsible for the accuracy and completeness of the information compiled for third parties and/or provided to third parties in connection with the Agreement.

3. If necessary for the execution of the Agreement, Scandinavian Dreams may request additional information. If this information is not provided, Scandinavian Dreams is entitled to suspend its services until the information is received, without being obligated to compensate the Traveler for any damages arising from this suspension. In the event of any changed circumstances, the Traveler must notify Scandinavian Dreams immediately, or no later than 3 business days after the change has become known.

4. Each Traveler is solely responsible for their own behaviour during participation in any Travel Services or activities.

 

Article 12 - Additional Work and Changes

1. If, during the execution of the Agreement, it becomes apparent that the Agreement needs to be adjusted and/or supplemented, or if additional work is required at the request of the Traveler to achieve the desired result, the Traveler is obligated to pay for this additional work according to the agreed rate. Scandinavian Dreams is not obliged to comply with this request. Furthermore, Scandinavian Dreams may require a separate Agreement to be concluded for such additional work.

2. If, and to the extent that a fixed price has been agreed upon for the provision of certain Travel Services, and the execution of these services leads to additional (urgent) work that cannot reasonably be expected to be included in the fixed price, Scandinavian Dreams is entitled to charge these costs to the Traveler, after consultation with the Traveler.

3. If a change needs to be made in the Agreement, and the cause of the change can be attributed to Scandinavian Dreams, any resulting damage to the Traveler will be borne by Scandinavian Dreams. If the cause of the change can be attributed to the Traveler, any resulting damage will be borne by the Traveler. If the cause of the change cannot be attributed to either the Traveler or Scandinavian Dreams, each party will bear its own damage.

 

Article 13 - Prices and Payment

1. Upon the conclusion of the Agreement, the Traveler must immediately pay an (advance) payment of up to 30% of the total agreed travel amount.

2. The Traveler must pay the remaining balance of the travel amount to Scandinavian Dreams no later than 60 days before the departure date. If timely payment is not made, the Traveler will receive a payment reminder, providing a 3-day period to settle the payment. Under special circumstances, the Traveler may pay the amount in further instalments if explicitly agreed upon with Scandinavian Dreams.

3. If an advance payment has been agreed upon, the Traveler must make this payment. If the advance payment is not made on time, the Traveler will receive a payment reminder. If payment is still not made, the collection policy will come into effect. Price increases and changes in availability of the Travel Services and/or activities may apply if the Traveler makes the payment at a later time.

4. If the Traveler is paying in instalments, Scandinavian Dreams is entitled to adjust the applicable prices and rates (only) in accordance with the terms of the Agreement, with a notice period of at least three months.

5. If the Traveler fails to meet their payment obligation or does not pay on time, Scandinavian Dreams is entitled to immediately terminate the Agreement, without being liable for any compensation or refund of any amounts already paid.

6. If the Agreement explicitly provides for it, prices may be increased after the conclusion of the Agreement in accordance with Article 7:507 of the Dutch Civil Code. Scandinavian Dreams will notify the Traveler in writing of any potential price increase no later than 20 days before the start of the Travel Services.

7. The Traveler is required to fully reimburse the costs of third parties, who are engaged by Scandinavian Dreams with the Traveler's approval, unless otherwise explicitly agreed upon.

8. The Traveler may not derive any rights or expectations from a preliminary budget unless the parties have explicitly agreed otherwise.

 

Article 14 - Collection Policy

1. When the Traveler fails to meet their payment obligation and has not fulfilled their obligation within the specified payment term, the Traveler will automatically be in default.

2. If the Traveler is a Consumer, they will first receive a further written reminder requesting payment of the owed amount within the specified period and informing them of the consequences of default. If the Traveler still does not pay, they will be considered in default.

3. From the date the Traveler is in default, Scandinavian Dreams will be entitled, without further notice of default, to charge the statutory commercial interest from the first day of default until full payment, as well as compensation for extrajudicial costs in accordance with Article 6:96 of the Dutch Civil Code, calculated according to the scale from the Decree on Compensation for Extrajudicial Collection Costs of July 1, 2012.

4. If Scandinavian Dreams has incurred additional or higher costs that are reasonably necessary, these costs will also be eligible for reimbursement. The full judicial and enforcement costs incurred will also be at the Traveler's expense.

 

Article 15 - Transfer of Risk

1. The risk of theft, loss, embezzlement, or damage to data, documents, data files, and/or items used, created, or delivered in the context of the execution of the Agreement, is transferred to the Traveler at the moment when these are actually placed at the Traveler's disposal.

 

Article 16 - Information Obligation, Assistance, and Support during Travel Services

1. Scandinavian Dreams is obliged to provide the prescribed standard information (the main characteristics of the Travel Services) in accordance with Article 7:502 in conjunction with 7:504 of the Civil Code.

2. If Scandinavian Dreams fails to provide correct or complete information, the provisions of Title 7A of Book 7 of the Civil Code regarding the Agreement shall apply. This particularly concerns the provisions related to the execution of the Travel Services, complaint procedures, obligations of assistance and support, termination options, and substitution.

3. If the Traveler and/or their travel companions require assistance or support, Scandinavian Dreams will provide information about local authorities, medical services, and consular assistance, as well as help Travelers in using remote communication and finding alternative travel arrangements. If assistance is needed due to the wilful act or negligence of the Traveler and/or their travel companions, Scandinavian Dreams is entitled to charge a reasonable fee to the Traveler.

 

Article 17 - Travel Documents

1. The necessary travel documents will be provided to the Traveler no later than 7 days before the departure date, unless this is reasonably not required from Scandinavian Dreams.

2. The Traveler will receive proof of the booking for the various components of the Agreement immediately upon booking.

3. If the Traveler has not received the (complete) travel documents no later than 3 business days before the departure date, the Traveler must immediately notify Scandinavian Dreams.

4. Upon receipt, the Traveler must immediately check the travel documents carefully for any errors and, if any errors are found, contact Scandinavian Dreams immediately.

 

Article 18 - Privacy, Data Processing, and Security

1. Scandinavian Dreams handles the (personal) data of the Traveler and the Travelers with care and will only use it in accordance with applicable standards. If requested, Scandinavian Dreams will inform the individual involved about this.

2. The Traveler is responsible for the processing of data that is processed using a Travel Service provided by Scandinavian Dreams. The Traveler also ensures that the content of the data is not unlawful and does not infringe any third-party rights. In this context, the Traveler indemnifies Scandinavian Dreams against any (legal) claims related to these data or the execution of the Agreement.

3. If Scandinavian Dreams is required to provide security for information based on the Agreement, the security will meet the agreed specifications and a level of security that, considering the state of technology, the sensitivity of the data, and the associated costs, is not unreasonable.

4. Scandinavian Dreams may, after obtaining the Traveler's consent, post one or more photos of the Travel Services and/or their review on, for example, Scandinavian Dreams' website and/or social media channels.

 

Article 19 - Suspension and Termination

1. Scandinavian Dreams is entitled to suspend the fulfilment of its obligations under the Agreement as soon as the Traveler is in default of fulfilling any obligation arising from the Agreement, including late payment of invoices. The suspension will be immediately confirmed to the Traveler in writing. In this case, Scandinavian Dreams is not liable for any damage, in any form, resulting from the suspension of its Travel Services.

2. All Travel Services are offered subject to (serious) unforeseen circumstances, such as extreme weather conditions and/or local circumstances that prevent or limit the execution of the Travel Services. In the event of unforeseen or unsafe circumstances that lead to the cancellation or exclusion of the Travel Service, Scandinavian Dreams is entitled to not execute a Travel Service and offer an equivalent alternative.

3. In such cases, Scandinavian Dreams is not liable for any damage, of any kind, resulting from the temporary suspension of its Travel Services. The suspension (and/or termination) does not affect the Traveler's payment obligations for any Travel Services already performed.

 

Article 20 - Force Majeure

1. Scandinavian Dreams is not liable if it is unable to fulfil its obligations under the Agreement due to a force majeure situation.

2. Force majeure on the part of Scandinavian Dreams is understood to include, but is not limited to: (i) force majeure of suppliers of Scandinavian Dreams, (ii) the failure of suppliers to properly fulfil their obligations, (iii) unforeseen changes to Travel Services by Service Providers, (iv) defects in goods, equipment, software, or materials from third parties, (v) government measures, (vi) power outages, (vii) internet, data network, and telecommunications facility failures (e.g., cybercrime and hacking), (viii) natural disasters, (ix) war and terrorist attacks, (x) general transportation issues, (xi) strikes, cancellations, and/or exclusions, and (xii) other situations that, in the judgment of Scandinavian Dreams, are outside its control and temporarily or permanently prevent the fulfilment of its obligations.

3. Scandinavian Dreams is not liable for a failure to fulfil an obligation due to unforeseen circumstances attributable to the Traveler or a third party, other than an assistant of Scandinavian Dreams.

4. Scandinavian Dreams is expressly not liable for snow reliability at the relevant travel location.

 

Article 21 - Limitation of Liability

1. If the provision of Travel Services by Scandinavian Dreams leads to liability on its part, such liability is limited to a maximum of the value of the travel sum, unless there is intent or negligence on the part of Scandinavian Dreams, or personal injury to the Traveler (other than that attributable to the Traveler themselves, as described in paragraph 4 of this article).

2. Scandinavian Dreams is not liable for general information in photos, brochures, and other promotional materials or information from (linked) websites to the extent that this has not been created by Scandinavian Dreams but by third parties.

3. Scandinavian Dreams is not liable for business damage, loss of profit, or any other loss, missed savings, or damage caused by business stagnation of the Traveler.

4. In particular, Scandinavian Dreams is not liable for circumstances attributable to the Traveler or the Traveler themselves. This includes, but is not limited to, ignoring instructions and/or warnings, reckless or incorrect actions, participation under the influence of alcohol, drugs, or medication, as well as any injuries or other harm sustained during the Travel Services.

5. Damage to clothing or other property of the Traveler caused by third parties (not being assistants in the sense of Article 6:76 of the Dutch Civil Code, who are not involved in the execution of the Agreement) is also excluded from the liability of Scandinavian Dreams.

6. Scandinavian Dreams is not responsible for errors and/or irregularities in the functionality of the website, interruptions, or the website being unavailable for any reason.

7. Scandinavian Dreams is not responsible for the timely receipt of emails. The Traveler has an independent obligation to monitor their email in a timely manner if they receive digital information. Scandinavian Dreams will take applicable legal deadlines into account in this regard.

8. The Traveler is responsible for the accuracy and completeness of the information provided regarding the assignment. Scandinavian Dreams explicitly excludes any liability for (consequential) damage resulting from executing the assignment based on incorrect information provided by the Traveler.

9. Any claims by the Traveler for a failure by Scandinavian Dreams expire if they are not reported in writing and substantiated to Scandinavian Dreams within one year after the Traveler became aware of, or reasonably could have become aware of, the facts on which they base their claims.

 

Article 22 - Confidentiality

1. Scandinavian Dreams and the Traveler are obligated to maintain confidentiality of all confidential information obtained in the context of an assignment. The confidentiality obligation arises from the assignment and must also be assumed when it can reasonably be expected that the information is confidential. The confidentiality obligation does not apply if the relevant information is already publicly available, the information is not confidential, and/or the information was not disclosed to Scandinavian Dreams during the Agreement by the Traveler and/or was obtained in another way by Scandinavian Dreams.

2. If Scandinavian Dreams is required to provide the confidential information based on a legal provision or a judicial decision to a third party specified by the law or competent court, and Scandinavian Dreams cannot invoke a right of privilege, Scandinavian Dreams is not required to pay any compensation and this does not give the Traveler grounds for terminating the Agreement.

3. For the transfer or dissemination of information to third parties and/or the publication of statements, advice, or productions provided by Scandinavian Dreams to third parties, the written consent of Scandinavian Dreams is required, unless such consent has been explicitly agreed upon in advance. The Traveler will indemnify Scandinavian Dreams for all claims from such third parties arising from reliance on such information that was disseminated without the written consent of Scandinavian Dreams.

4. Scandinavian Dreams and the Traveler also impose the confidentiality obligation on any third parties they engage.

 

Article 23 - Indemnification and Accuracy of Information

1. The Traveler is solely responsible for the accuracy, reliability, and completeness of all data, information, documents, and/or records provided to Scandinavian Dreams in the context of the Agreement. This applies even if the data is provided by third parties; the Traveler is still responsible for it.

2. The Traveler indemnifies Scandinavian Dreams from any liability resulting from the failure to fulfil the obligations set forth in the previous paragraph, whether due to inaccuracy, incompleteness, or tardiness.

3. The Traveler indemnifies Scandinavian Dreams against any claims from third parties regarding intellectual property rights over the data and information provided by the Traveler that may be used in the performance of the Agreement.

4. If the Traveler provides electronic files, software, or data carriers to Scandinavian Dreams, the Traveler guarantees that these are free from viruses and defects.

5. The Traveler is responsible for ensuring they have the necessary (travel) documents with them, such as a passport that meets all validity requirements, or where permitted, an identity card, and any required visas, proof of vaccinations, driver’s license, and insurance card.

6. It is the Traveler's responsibility to ensure that, if the Agreement involves the purchase of goods tied to specific dates and (starting) times, these requirements are adhered to, the goods are checked for accuracy, and the Traveler is present at the specified start time and location on the relevant dates.

 

Article 24 - Reporting Complaints During the Travel Services

1. If the Traveler experiences a shortcoming in the execution of the Agreement during the Travel Services, the Traveler must immediately report this to Scandinavian Dreams. To do so, the Traveler must call Scandinavian Dreams as soon as possible during the Travel Services. This allows Scandinavian Dreams to resolve the issue, if possible, on-site and immediately.

2. If the Traveler fails to comply with the reporting obligation in the previous paragraph during the Travel Services and, as a result, does not allow Scandinavian Dreams to resolve the shortcoming on-site and immediately, or at least within a reasonable timeframe, any right to compensation may be limited or excluded.

 

Article 25 - Other Complaints

1. If the Traveler is not satisfied with the Travel Services provided by Scandinavian Dreams or has other complaints regarding the execution of their assignment, the Traveler is obliged to report these complaints as soon as possible, but no later than 7 calendar days after the occurrence that led to the complaint. Complaints can be reported orally or in writing via info@scandinaviandreams.eu with the subject "Complaint".

2. The complaint must be sufficiently substantiated and/or explained by the Traveler for Scandinavian Dreams to process the complaint.

3. Scandinavian Dreams will respond substantively to the complaint as soon as possible, but no later than 20 calendar days after receiving the complaint.

4. The parties will attempt to reach a solution together.

 

Article 26 - Applicable Law

1. Dutch law applies to the legal relationship between Scandinavian Dreams and the Traveler.

2. Scandinavian Dreams has the right to amend these general terms and conditions and will notify the Traveler of such changes.

3. Any disputes arising from or related to the Agreement between Scandinavian Dreams and the Traveler will be settled by the competent court of the Oost-Brabant district court, unless mandatory provisions of law designate a different competent court.

4. In the case of translations of these general terms and conditions, the Dutch version shall prevail.
